Did anything actually come about from that agreement that was mentioned a while back, where we were due to get a statement the next day (several days ago)?

No, the YT strikes need removing first. I think Andrews sent Youtube a telex or something

I don't follow it but from what I have seen here (Character assassination videos and unattributed facebook posts) then yes the spectrum scene is toxic. And to top it off with a cry of "there is bad on both sides" speaks volumes. And now we see people accusing her of being some sort of "crisis actor".

All unfortunate methods.

Using conspiracy theory bullshit like ‘crisis actor’ does your personal position on this no favours.

If you are taking that video at 100% face value then that’s your call. Some people think they’ve played it up too much.

I didn't say I took it 100% at face value...

What I am saying is that I am seeing a certain type of posts coming from the "other side" - There is bad on both sides! - misogyny! - oh she's not really that upset! - TITS!...

Just ignore them.

My point was that the commercialisation is an inevitable byproduct of the community expanding. And that there are a lot of positives to it, as well.

I agree with on that, my friend. I just think it’s a double-edged sword, as it has also lead the to loss of online resources, the emergence of copyright trolls and chancers, and countless dead-end crowdfunding campaigns. Among other such negatives. I think my main issue is that fans and amateurs were often far better custodians and curators of retro gaming than many of the nominal IP owners, the latter often no longer even people who had any hand in creating/designing the fondly-remembered old games and computers.

apparently the IP holder of the Jupiter Ace has requested that the Jupiter Ace emulator be removed from a Spectrum Next software distribution thing as well as other emulator distributions... Apparently it uses the core of the Ace. So they must be protecting that gold pretty well from other legitimate channels!

Fucking hell. That’s just petty vandalism – it’s only been the efforts of enthusiasts over the last 35+ years which has preserved obscure computers like the Jupiter Ace in any shape or form.

We are no threat to WoS. We don't own any IP - we just license it. So we have no power (or indeed desire) to enforce any copyright.

On top of that our service is built around streaming , and the added value that online leaderboards, tournaments, challenges etc bring to retro gaming. So we don't even consider archive sites to be competition.

I agree that sites such as WoS and related fan bases can only do good for services such as Anstream, this statement irks me.

Can you explain to the readers why one of your directors along with his business partners have spent the last few years emailing the WoS hosts repeatedly trying to get the site shut down? To the point where they are happy to keep a record of all contact, which includes fake copyright claims, just in case I decide to pursue a claim for harassment?

This doesn't sound to me like a company that is no threat to WoS....

I’ve seen no mention of the Jupiter Ace being removed from the Spectrum Next, even on the official Next Facebook group, so I’m not sure where that story is coming from?

just do a  search in the ZX Spectrum Next Facebook group  for "Jupiter Ace" the 2nd response is this

https://www.facebook.com/groups/specnext/permalink/716333425390647/

It has comments there pointing to the owner (Andrews). The issue being the emulator/NEXT Jupiter Ace emu/core needed the Jupiter Ace rom which he has the rights to.

I am not sure what he has planned for it but the Jupiter Ace group is active.

Personally I think gatekeeping the obscure platforms of the distant past so that people cannot easily emulate them is a mistake. I guess we have to hope the original hardware continues to survive (several hundred quid to buy one on Ebay)

Well partially I think people care because during the vega affair Andrews was seen as a great positive influence on the community,  and defender of the backers and a supporter of the retro community in general. Some people felt more inclined to support his projects due to these positive vibes he created.

Turns out that image isn't quite accurate.

If you don't care then that is fair enough, it isn't compulsory.

The damage that's been done to the family-friendly image of much-loved children's character Horace from Horace Goes Skiing must be incalculable. This guy's life must be in tatters after all this, not to mention the lives of children worldwide.

"Mummy, why has the family friendly character of Horace from Horace Goes Skiing been portrayed in an unsuitable manner, for profit, by a Youtuber who didn't even ask permission from the IP holder?"

"I don't know, Zebedee. I just don't know."

To be fair, so many people seem to be cancelling orders of his products, badmouthing him on social media and threatening to turn up at his house to assault him!

I know you are taking the p, but from the outside looking in, i think it has had a terribly negative effect on him.

what do you mean, didnt sign a letter? I assume it was send electronically?

I hate to be the one to say this, but that response was a gag based on the Prime Minister's approach to a legally-required extension of The Thing We Should Not Discuss Anywhere Really.

I could spot it was satire, but hey, an inability to spot such humour appears to be endemic on one side of this argument. ;-)

If Paul Andrews statement is true, then what we’re talking about is someone refusing to give a donation to charity in return for using a character - not just in their videos but also selling as soft toys.

I guess then it’s Ok for Disney to sell Peter Pan toys without giving money to Great Ormond Street?

Thats the real rub in this. He wasn’t asking for all the revenue. He wasn’t asking her to remove the videos, stop using the character or stop selling the soft toys. He asked for a charitable donation in return for using the character and (yes, according to Paul Andrews) she refused to do it. When her videos get removed and she was hit by copyright strikes, she has to make a tearful video saying her livelihood has been taken away which in turn caused a mob like response from people without even having heard the other side of the story (threats of physical violence, wtf?? )

Everyone agress that the soft toys are out of line.

But they weren't being sold by Octav1us were they?
